1. Agreement to these terms

These Terms & Conditions (“Terms”) are a binding agreement between you and (Un)Cubed, LLC, doing business as PottiPing (“PottiPing,” “we,” “us,” “our”). They govern your use of the website at pottiping.com, the PottiPing mobile app, the PottiPing button, and related services (together, the “Service”). By joining the waitlist, creating an account, or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

2. Who may use PottiPing

You must be at least 18 years old and able to form a binding contract to create an account or use the Service. PottiPing is intended for parents, caregivers, and other adults. By using it, you represent that you meet these requirements and that any information you provide is accurate.

3. What PottiPing is

PottiPing is a small button and companion app: someone presses the button, and members of your household get a notification (a “ping”) on their phone. The Service includes the waitlist, the app, the button’s connection to the app, an activity/ping history, and optional features you can turn on (like Alexa announcements or webhooks). We may add, change, or remove features over time.

4. Your account & household

• Keep your login credentials confidential; you’re responsible for activity under your account.
• When you invite co-parents, sitters, or other members to your household, you’re responsible for who you invite. Members you add can receive pings and see household activity based on their role.
• Tell us promptly at hello@pottiping.com if you suspect unauthorized use.

5. PottiPing is not a safety, medical, or monitoring device

A ping only means the button was pressed. It doesn’t confirm where a child is, what they’re doing, or that they’re safe. You are responsible for supervising children in your care. PottiPing is meant to make family routines a little easier — nothing more.

6. Notifications are best-effort

Pings depend on things outside our control — your WiFi and internet connection, your button’s battery and power, your phone and its settings, notification and focus modes, and third-party networks and services (including Apple, Google, and your carrier). Notifications may be delayed, duplicated, delivered out of order, or not delivered at all, and history may be incomplete. We don’t guarantee delivery, timing, or accuracy of any ping.

7. The button (hardware)

• The button connects over Bluetooth for setup and then to your home WiFi (2.4 GHz). Setup and reliable operation depend on your network and environment.
• Follow the setup and care instructions we provide. The button is an electronic device — keep it dry unless we say otherwise, and keep small parts and batteries away from young children, who should be supervised around it.
• Don’t open, modify, or misuse the device, or use it in a way that could be unsafe.
• When the button is available for purchase, your purchase will be covered by separate sale terms, warranty, and return/shipping policies provided at checkout. These Terms govern your use of the Service; they aren’t an offer to sell hardware.

8. Waitlist & orders

Joining the waitlist reserves nothing and obligates no one. It simply lets us email you about availability. We make no promise about if, when, at what price, or in what quantity PottiPing will be offered, and we may change plans at any time. Any future order will be subject to the sale terms presented at that time.

9. Acceptable use

You agree not to:

• Use the Service unlawfully, or to harass, harm, or infringe the rights of others;
• Access accounts, households, or devices that aren’t yours, or disrupt or probe the Service’s security;
• Reverse-engineer, decompile, scrape, or attempt to extract source code or data except as the law expressly permits;
• Resell, rent, or commercially exploit the Service without our written permission;
• Use the Service in a safety-critical way (see Section 5) or in violation of any third-party service’s terms.

10. Third-party services

PottiPing works with services we don’t control — your WiFi and phone, Apple and Google, and optional integrations you enable (such as Amazon Alexa or a webhook you configure). Your use of those services is governed by their terms and privacy policies, and we’re not responsible for them. If you connect an integration, you’re directing us to share the limited data described in our Privacy Policy with that service.

11. Intellectual property & your feedback

PottiPing, including the app, website, button design, software, “PottiPing” name, logo, and content, is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service as intended. You keep any rights to content you submit; by sending us feedback or suggestions, you grant us a perpetual, worldwide, royalty-free license to use them to improve the Service, without obligation to you.

12. Changes, suspension & termination

We may modify or discontinue the Service (or any feature) at any time. We may update these Terms; if we make material changes, we’ll update the date above and notify account or waitlist members where appropriate, and your continued use means you accept the updated Terms. We may suspend or terminate your access if you violate these Terms or to protect the Service or others. You can stop using the Service and delete your account anytime. Sections that by their nature should survive (for example, 5, 11, 13–16) survive termination.

13. Disclaimers

THE SERVICE AND THE BUTTON ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT NOTIFICATIONS WILL BE DELIVERED. SOME JURISDICTIONS DON’T ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POTTIPING AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, OR ANY DAMAGES ARISING FROM A DELAYED, MISSED, OR INACCURATE NOTIFICATION OR FROM RELIANCE ON THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR US$100. THESE LIMITS ARE A FUNDAMENTAL BASIS OF OUR AGREEMENT. SOME JURISDICTIONS DON’T ALLOW CERTAIN LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold PottiPing harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms or of any law, or your infringement of another’s rights.

16. Governing law & disputes

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Before filing anything, you agree to first contact us at hello@pottiping.com so we can try to resolve the issue informally.

You and PottiPing agree that any dispute that isn’t resolved informally will be brought exclusively in the state or federal courts located in Hamilton County, Ohio, and you consent to their jurisdiction. To the extent permitted by law, you and PottiPing waive any right to a jury trial and agree that claims must be brought individually, not as part of a class action.

17. General

• These Terms and the Privacy Policy are the entire agreement between you and us about the Service.
• If any provision is unenforceable, the rest stays in effect.
• Our not enforcing a provision isn’t a waiver of it.
• You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
• Notices to you may be sent by email or posted in the Service.
